SC said- The membership of the Waqf Board will automatically be considered canceled when the membership of the Bar Council is over.
The Supreme Court on Tuesday gave an important verdict regarding the appointment to the State Waqf Board. The court said- Only the active member of the State Bar Council can become a member of the State Waqf Board.
The bench of Justice MM Sundresh and Justice Rajesh Bindal, while giving the verdict, said that 2 mandatory conditions have to be met to become a member of the Waqf Board.
First- The person should be from the Muslim community. Second- The post should be active as a member of Parliament, State Assembly or Bar Council.
The Supreme Court declared the decision of the Manipur High Court as wrong, in which the High Court said that the law is not clear that the membership of the Waqf Board will also end when the bar is out of the council.
Know the whole matter … This case of the State Waqf Board was related to Mohammad Feroz Ahmed Khalid of Manipur, who was appointed as a member of the Manipur Waqf Board in February 2023. He joined the Waqf Board after becoming a member of the Bar Council in the December 2022 election. He had replaced the person who lost the election of the Bar Council.
Khalid’s appointment was valid by a single bench of the High Court, but the Division Bench reversed the decision, saying that it is not clear in the law that the Waqf Board members would end when it is out of the bar council. The SC reported that according to the Waqf Act, if the membership of the Bar Council is finished, the membership of the Waqf Board will be considered automatically canceled.

How much property does Waqf Board have Different claims are made in different media reports regarding the assets of all 32 Waqf Board of the country, but in 2022, the Government of India said that there are more than 7.8 lakh Waqf immovable assets in the country. Most of these Uttar Pradesh Waqf has more than two lakh immovable properties.
Supreme Court lawyer Virag Gupta says that after 2009, the assets of Waqf have increased double. The Ministry of Minority Welfare gave information in the Lok Sabha in December 2022, according to which the Waqf Board has 8,65,644 immovable properties. The estimated price of about 9.4 lakh acres of Waqf lands is 1.2 lakh crores.

On April 5, President approves Waqf Act, Gazette Notification released

The Waqf Amendment Bill (now Law) passed on April 2 after a discussion of 12-12 hours in the Lok Sabha and the Rajya Sabha on 3 April. After this, President Draupadi Murmu approved the bill late on 5 April. The government has issued a gazette notification regarding the new law. The central government will issue separate notifications regarding the date of implementation of the law.
During the discussion on the bill, Union Minister Kiren Rijiju had said- The purpose of the law is to prevent bias, misuse and encroachment in Waqf properties. The bill was supported by 128 members in the Rajya Sabha, 95 protested. This bill was passed in the midnight of 2 April in the Lok Sabha. During this period, 288 MPs voted in support and 232 in protest.
