The Supreme Court on Wednesday (26 March) directed all the states to strictly take strictness on false and misleading advertisements. The court said that all governments should create a system within 2 months to hear the complaint against misleading advertisements.

In fact, in 2022, the Indian Medical Association (IMA) filed a petition in the Supreme Court. In this, Patanjali and Yogguru Ramdev were accused of propagating against Kovid vaccination and Modern Medical Science. Since then, the court has taken a tough stand on misleading advertisements.

Justice Abhay S., hearing misleading advertisement on Wednesday. The bench of Oka and Ujjal Bhuiyan issued this order. The court said that the police should also be made aware of strict action under the ‘Drugs and Magic Remedies Act, 1954’ to curb misleading advertisements.

What will happen after this order?

  • In two months, all states will have to create a grievance redressal system.
  • The public will have to give information about this system every three months.
  • Police will be trained for action under the 1954 law.

If the state governments do not follow this order till 26 May 2025, the Supreme Court can take further steps. The court’s decision is expected to tighten the companies and brands that sell products with false claims.

What was Patanjali’s misleading advertising case?

Patanjali launched Koronil in 2020 during Kovid. Claimed that this would end the corona in 7 days. In 2021, the Ministry of AYUSH said that Koronil Korona is not treated. In 2022, Patanjali printed a half -page advertisement in the newspapers. It said that pharma and medical industries spread the misconceptions, protect themselves and the country from it. On this, IMA filed a petition in the Supreme Court in August 2022. The Supreme Court directed Patanjali to stop misleading advertisements in November 2023. The Supreme Court reprimanded Patanjali in 2024 for not stopping the misleading advertisement. After this, on 16 April 2024, Patanjali apologized.
