The court admitted that pregnancy pose a serious threat to the life and health of the girl. It was very dangerous for him to give birth to a child due to diseases.
The victim from Kandhamal in Odisha is from the Scheduled Castes (SC). Last year, a boy raped her several times. He did not tell anyone anything due to threats. When the girl’s health started deteriorating, the mother took her to the doctor. After this, a case of rape came up.
On 11 February, the victim’s parents lodged an FIR. The girl underwent medical examination. The investigation revealed reports of pregnancy and health problems related to it. The matter then reached the Orissa High Court, where the girl’s father sought permission for abortion.
Medical Board said- Child girl threatens due to pregnancy Last month, the court ordered the MKCG Medical College of Balrampur to be made a medical board to investigate the girl. The board told the court that pregnancy would be a serious threat to the girl’s physical and mental health.
After the report, the state government did not object to the petition. The government said that forcing the girl to have a child will be a violation of their fundamental rights under Article 21 of the Constitution. The court then allowed abortion.
The court also directed the Odisha government to create a standard operating procedure (SOP). The court said that the government should ensure that the treatment of the girl is properly. Bureaucracy does not become an obstacle and the law -enforcement agencies handle it better. The court ordered the SOP to be implemented within 6 months.
The 27 -week pregnancy, abortion rule is a 24 -week -old victim of more than 27 months pregnant, which is more than the 24 -week limit. In certain cases in certain cases in the Medical Termination of Pregnancy (MTP) Act, abortion is allowed even after 24 weeks, including minor and rape victims.
