The Supreme Court reprimanded a lawyer who was demanding to postpone the hearing of a case. The court said that the hearing will not be postponed only by taking the name of a senior lawyer.
Actually this case was related to a commercial dispute. The lawyer requested the court to postpone the hearing for four weeks as senior advocate Harish Salve is out of the country at this time and he will debate the case.
Justice Oka and Bhuiyan’s bench expressed displeasure
A bench of Justice Abhay S Oka and Ujjal Bhuiyan expressed displeasure over the lawyer’s demand. The court said, “Do you think if you name a senior lawyer, we will postpone the hearing? This habit should now stop.”
Instructions to maintain the dignity of the judiciary
The bench said that the lawyers of the bar have to understand that the court does not take decisions only by listening to the names of big or senior lawyers. There is a need to stop such a habit.
Still hearing in Supreme Court
However, when the matter later came to hear again, the court accepted the appeal of the lawyer and gave the next date. Despite this, the court made it clear that taking the name of a senior lawyer cannot become the basis for postponing the hearing.
Supreme Court reprimanded earlier also
The Supreme Court has already instructed the lawyers to maintain the dignity of the court. In January, the court reprimanded a lawyer who was sitting in the car and attending the hearing. The court had said that it is necessary to maintain dignity during judicial proceedings.
