Imran Pratapgarhi posted a 46 -second video clip of Kavita on his X handle on 29 December. The song ‘Aye Khoon Ke Pyaasa Baat Suno’ was playing in the background.

The FIR lodged by the Gujarat Police against the Congress Rajya Sabha MP Imran Pratapgarhhi on Friday canceled. This FIR was recorded with his Instagram post ‘Ae Khoon Ke Pyaasa Baat Listen’ poetry. The court, while emphasizing the freedom of expression in the judgment, questioned the sensitivity of the police and the lower courts.

A bench of Justice Abhay S Oka and Justice Ujjwal Bhuiyan said, “There has been no crime. When the allegations are in writing, the police officer should read it carefully. It is necessary to understand the true meaning of the words spoken. There is no message of violence in poetry, but it promotes non -violence.”

Justice Oka said on the functioning of the police, “Even after 75 years of the Constitution, the police should understand the importance of freedom of expression. This right should be preserved even when a large number of people dislike it.”

No controversial thing in poetry- Supreme Court

Justice Abhay Oka said that even if the judges do not like anything, it is still necessary to give constitutional protection to freedom of expression. Free speech is one of the most valuable rights. When the police do not respect it, the courts should come forward and protect it.

The court said that even though many people dislike someone’s views, the person’s right to express ideas should be respected and protected. Literature, including poetry, drama, film, satire and art, makes human life more meaningful.

FIR was done on 46 second video

The FIR alleges that Imran Pratapgarhi posted a 46 -second video clip of Kavita on his X handle on 29 December. The song ‘Aye Khoon Ke Pyaasa Baat Suno’ was playing in the background. Imran Pratapgarhi posted this social media after attending the mass dedication ceremony held in Jamnagar.

Relief was not provided from the High Court

A case was registered against Pratapgarhi under Section 196 (promoting enmity on the basis of religion or race) and 197 (harmful statement to national unity). The High Court had said that the investigation is in the initial stage and Pratapgarhhi did not cooperate in the investigation. He then appealed to the Supreme Court.

Pratapgarhi said- Kavita gives the message of love and non-violence

This video clip of Pratapgarhi shows that when he was walking with his hand, he was raining the petals of flowers and a song was playing in the background. Pratapgarhi, in a petition filed to cancel the FIR, claimed that poetry reading in the background gives the message of love and non -violence.
