- Faridabad: BJP created history here. The party candidate here, Praveen Joshi, made a win from the most differences so far. There are 46 wards here. 3 important things related to civic elections in Haryana
- 1. Not the word councilor in the constitution: According to Advocate Hemant Kumar of Punjab and Haryana High Court, there is no designation of a councilor in Haryana. In the certificate of victory, only members are written. In contrast, they are given the designation of councilor in other states Punjab, Himachal Pradesh, Uttar Pradesh, Rajasthan etc. It is mentioned in his municipal laws. It is not mentioned in the Haryana law.
- 2. Controversy on the format of oath: According to the format of swearing in in the third schedule of the Constitution of India, every newly elected member has a faith in God or a believer, then he can take an oath of office in the name of God. If he does not want to take the oath of God in this way, then he can also interested in integration. At the same time, the oath format given under Section 24 (1) of Haryana Municipal Corporation Act 1994, mentions only to take oath in the name of God. There is no mention of intelligence in lieu of it.
- 3. 2 Provisions in Corporation Act for Mayor Election: The Municipal Corporation Act-1994 of Haryana has not one, but 2 rules for the mayor election. The government amended the Haryana Municipal Corporation Act-1994 in September 2018. In this, it was decided that now the election will not be done directly, not the councilors of the mayor’s wards. The government amended the Act, but the Section 53 in the Act to choose the mayor of ward councilors was not removed. According to legal experts, if the councilor challenges the elected mayor of the public with a majority in the court, then the legal screw can be stuck.
