23 years after the Godhra tragedy in Gujarat, the Gujarat High Court has upheld the decision to remove nine railway police personnel from the job for negligence in patrolling the Sabarmati Express train.
High Court Justice Vaibhavi Nanavati dismissed the petition of the policemen, saying that if the petitioner policemen were doing their duty in the Sabarmati Express train, the Godhra tragedy could have been stopped.
Applicants took gross negligence towards their duties and responsibilities.
The petitioners were working in the Railway Police at that time. He was given the responsibility of patrolling in Sabarmati Express on 27 February 2002, but since he missed the train, he reached Ahmedabad early by another train.
On this day, the S-6 coach of Sabarmati Express was set on fire in Godhra, killing 59 passengers including kar sevaks returning from Ayodhya.
After this incident, communal riots erupted across Gujarat and continued for two months.
Removed from job in November 2005 9 police personnel were suspended on 1 March 2002 due to negligence in duty. He was followed by a departmental inquiry against him and in November 2005 he was removed from his job.
He appealed against it, but the local court rejected the appeal. On this, he filed a petition in the High Court.
The duty of these policemen who filed the petition was in the Sabarmati Express train- Gulab Singh Jhala, Khuman Singh Rathore, Nathabhai Dabhi, Vinodbhai Bijalbhai, Jabirhusain Sheikh, Rasikbhai Parmar, Kishore Parmar, Kishorebhai Patni and Punabhai Baria.

It is common for policemen to take plenty-optional trains During the hearing, the petitioner policemen argued that their duty was to patrol between Kalupur and Dahod railway station. He reached Dahod by Rajkot-Bhopal Express and was about to board the Sabarmati Express from Dahod to Ahmedabad.
But due to the delay of Sabarmati Express, he rode on Shanti Express and reached Ahmedabad. On reaching Ahmedabad, he came to know that the S-6 coach of Sabarmati Express had caught fire.
It is common for mobile police to take alternative trains during duty.
The High Court Justice Vaibhavi Nanavati dismissed the petition in a 110 -page judgment, saying that the petitioner had come to Ahmedabad by Shanti Express and made a fake entry in the register. If they were on the Sabarmati Express train, the incident of Godhra could have been stopped.
Applicants have shown negligence towards their duties. He is proved by accusations. In view of the above allegations, an order has been passed to dismiss him from service.
