Action is going on on the madrasas of the Uttarakhand government. On Sunday, the Uttarakhand government has raided 6 madrasas in Balbhunpura area of Haldwani. These madrasas are accused of lack of recognition and violation of security and hygiene standards.
During this time heavy police force was deployed with the administration. Along with this, police force has been deployed later, so that there is no violence in the area.
Madrasas were running inside mosques
Additional District Magistrate of Haldwani Vivek Rai said that most of these madrasas did not have educational or government recognition. Apart from this, there was a lack of proper sitting, toilets and cleanliness. Also, necessary arrangements for security like CCTV were also not found here.
At the same time, some madrasas were found to be operating inside the mosque which is wrong according to the rules.
Administration demolished madrasa in Panna
The administration has demolished the illegal madrasa built on government land in ward number 26 BD Colony of Panna. The action was taken after the complaint of Waqf Board District President Abdul Hameed alias Bati and Salim Khan.
Madrasa operator Abdul Rauf and some members had earlier started demolishing the building themselves. The administration carried out the entire action on Saturday night. The team of ADM, Tehsildar and Municipal Corporation reached the spot and made the entire building with bulldozers.
According to Tehsildar Akhilesh Prajapati, the land of the madrasa was examined a month ago. In the investigation, this land was found government. After this, a notice was issued to the madrasa operator to remove the encroachment.
Madrasas were given relief by the Supreme Court in 2024
Action was started against madrasas in Uttar Pradesh before Uttarakhand and Madhya Pradesh. The National Child Rights Protection Commission i.e. NCPCR recommended the court that if madrasas are being closed in UP, then children studying in them should adjust to other schools. After this, the Supreme Court, while giving the verdict, banned the decision to close the madrasas of UP. Along with this, the court had also stayed the order of Uttar Pradesh and Tripura government in which students studying in madrasas were to be transferred to a government school. This includes non-Muslim students studying in non-recognized madrasas as well as government aided madrasas.
NCPCR said- Right to Education Act in madrasas is not being followed
The National Commission for Protection of Child Rights (NCPCR) said on 12 October that the recognition of madrasas who did not follow the ‘Right to Education Act 2009’ should be canceled and should be investigated. The NCPCR had written a letter to all the states and said that the funds given to madrasas should be closed. These do not follow the Right-to-Eguation (RTE) rules.
The Commission suggested this after preparing a report called ‘Patron of faith or opponents of rights: Vyas Vs. Madrasa’ of children. The commission had said that, ‘The entire focus in madrasas remains on religious education, due to which children do not get the necessary education and they fall behind the rest of the children.’
Timeline of UP madrasa dispute …
The year 2004- The UP Board of Madrasa Education Act, 2004 was brought to improve the education system of madrasas. Under this law, some eligibility criteria were also fixed to get recognition from the board for madrasas. The board used to prepare syllabus for madrasas, train teaching materials and teachers.
The year 2012- The petition was first filed against the Madrasa Act by Sirajul Haq, manager of Darul Uloom Vasia Madrasa in 2012. Then in 2014, the petition was filed by Abdul Aziz, Secretary of Minority Welfare Lucknow and Mohammad Javed of Lucknow in 2019. After this, in 2020, Rijul Mustafa filed two petitions. In 2023, Anshuman Singh Rathore filed a petition. All matters were nature. Therefore, the High Court merged all the petitions.
The year 2022- The UP government received inputs from social organizations and security agencies that madrasas are being operated illegally. On this basis, Uttar Pradesh Council and Minority Minister had decided to conduct a survey. After this a 5 -member team was formed in every district. It consisted of District Minority Officer and District School Inspector.
A survey of madrasas was conducted from 10 September 2022 to 15 November 2022. This time limit was later extended to 30 November. In this survey, about 8441 madrasas were found in the state, which were not recognized.
March 2024- The Allahabad High Court has declared the Madrasa Education Act, 2004 of Uttar Pradesh unconstitutional. On 22 March, the Lucknow bench of the court has said that the Madrasa Board of Education of Uttar Pradesh is against secularism, Article 14, 15 (Right to Equality) of the Indian Constitution and 21-A (Right to Education). After this, the court has also ordered the transfer of children studying in madrasas to other schools.
The Uttar Pradesh government said in the Supreme Court that children studying from madrasas deserve only 10th-12th qualified jobs.
However, in March itself, the Supreme Court stayed the Allahabad High Court’s decision to declare the ‘UP Board of Madrasa Education Act 2004’ unconstitutional. Along with this, the Central and UP government also sought answers. The court said that the decision of the High Court will affect 17 lakh students. It is not right to instruct students to transfer to another school.
The bench said that the High Court is not first correct. It would be wrong to say that this Madrasa Act violates secularism.
NCERT syllabus applicable in UP madrasas
NCERT courses are being implemented in all madrasas of the state including Lucknow. Registrar of Madrasa Board R.P. Singh said that NCERT has been implemented from the new academic session 2025-26. Now children studying in madrasas from classes 1 to 3 will get education from NCERT books. NCERT books will be provided to the children of all madrasas of the state on the lines of Basic Education Council. In this regard, instructions have been issued by the Madrasa Education Council.
